29 CFR 1910.134(c )(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) On or about April 23, 2020 and thereafter, at Glen Cove Center for Nursing and Rehabilitation, 6 Medical Plaza, Glen Cove, NY - The employer failed to develop and implement a written respiratory protection program for employees including, but not limited to, nurses, Certified Nursing Assistants, and physical therapists who provided direct medical care to residents with suspected or confirmed COVID-19. The employer provided the employees with tight-fitting N-95 respirators and respirators were necessary when employees provided care to suspected or confirmed COVID-19 patients. Job duties included, but were not limited to, assisting residents with feeding or oral care, providing medication to residents, taking residents vitals, and assisting residents with mobility.

The employer did not provide these employees with a medical evaluation to ensure the employee was capable of safely wearing a respirator such as an N-95.

The respirators were allowed to be stored in closed plastic Ziploc storage bags between uses instead of breathable paper bags.

The employer failed to provide training on the following: a) Why the respirator is necessary and how improper fit, usage, or maintenance can compromise the protective effect of the respirator; b) What the limitations and capabilities of the respirator are; c) How to use the respirator effectively in emergency situations, including situations in which the respirator malfunctions; d) How to inspect, put on and remove, use, and check the seals of the respirator; e) What the procedures are for maintenance and storage of the respirator; and f) How to recognize medical signs and symptoms that may limit or prevent the effective use of respirators.
