29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about August 12, 2020, located at 3898 Clark-Shaw Road, Powell, Ohio, the employer failed to ensure that two employees who worked on top of the second floor level of a new build residential home were protected from falling to the ground level.  The employees were exposed to falls from elevation above six feet without being protected from falling to the ground level.  Within the past five years, the employer had been cited for the same hazard in a different inspection.  Julio Balvanera, was previously cited for a violation for this Occupational Safety and Health standard, which was contained in OSHA inspection number 1445952, citation number 2, item number 2 and was affirmed as final order on January 08, 2020, with respect to a workplace located at 7263 Lilac Hill Drive, Lot 1285, Plain City, Ohio 43064.  Julio Balvanera, was previously cited for a violation for this Occupational Safety and Health standard, which was contained in OSHA inspection number 1089784, citation number 1, item number 1 and was affirmed as final order on November 24, 2015, with respect to a workplace located at 5095 Buttergreen, Lot 276, New Albany, Ohio 43054.
