OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from falling or collapsing wood trusses. Kolby Construction LLC at the worksite of 148427 Smore Lane in Mosinee, Wisconsin: On August 18, 2020, employees installing truss spacers and nailing bottom chords to wall top plates were exposed to struck-by hazards when walking on and between trusses that had not been braced to resist out-of-plane buckling, leaning, and/or collapse due to the lack of top chord, web member, and bottom chord bracing.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. On August 18, 2020 at 148427 Smore Lane in Mosinee, Wisconsin, employees installing trusses were walking on wall top plates and/or bottom chords nine feet four inches above surface level without utilizing fall protection equipment.

29 CFR 1926.503(a)(2)(iii): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used. On August 18, 2020 at 148427 Smore Lane in Mosinee, Wisconsin, the employer did not provide required fall protection safety training for employees who did not associate fall from elevation hazards when working at heights greater than six feet without utilizing fall protection equipment.
