29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace and as referenced by the note contained in 1926.602(d): 210 SW Cutoff, Worcester, MA: On August 25, 2020 and at times prior, the employer operated telehandler lifting vehicles with only on-the-job training instead of the formal training that required training to consist of a combination of formal instruction, practical training, and evaluation of the operator's performance.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. Specifically, ANSI B56.1-1969, 604.I. Operating Safety Rules and Practices: Traveling: Travel with load engaging means or load low and, where possible, tilted back. Do not elevate the load except during stacking. 210 Southwest Cutoff, Worcester MA: On August 25, 2020, the employer operated an unloaded telehandler over an uneven surface with the load engaging means over ten feet above ground. The telehandler became unstable while moving forward and tipped over exposing nearby employees to crushed by hazards.
