29 CFR 1910.22(c): The employer must provide, and ensure each employee uses, a safe means of access and egress to and from walking-working surfaces.   On or about August 21, 2020 and prior to that time the employer did not provide and ensure a safe means of egress to and from walking-working surfaces in that, industrial machine operator(s) climbed from a step ladder onto the Amerimulch Colortrom Coloring Machines framework with a 32 inch change of elevation climb to gain access to the hopper exposing employees to a fall potential of 8 feet from the top of the elevation change in access to the top of the hopper.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: Guardrail Systems, Safety Net Systems, Personal Fall Protection Systems such as Personal Fall Arrest, Travel Restraint or Positioning Systems.    On or about August 21, 2020 and prior to that time industrial machine operator(s) not protected by conventional fall protection worked from within the Amerimulch Colortrom Coloring Machines hopper to unclog or clear plugged mulch while standing on the walking-working surface created by the mulch adjacent to the perimeter exterior unprotected sides or edges of the hopper exposing employees to fall potentials in excess of 6 feet.

29 CFR 1910.332(b)(1): Employees shall be trained in and familiar with the safety-related work practices required by 1910.331 through 1910.335 that pertain to their respective job assignments.  On or about July 23, 2020 an employee was not trained in and familiar with the safety-related work practices that pertained to respective job assignment while working within the Amerimulch Colortrom Coloring Machines control panel exposed to contact with parts of fixed electric equipment or circuits without all circuits and equipment to be worked on being disconnected, verified from all electric energy sources and a lock / tag being placed on the electrical voltage energy 480 volt Eaton electrical disconnecting means power source used to deenergize circuits.

29 CFR 1910.333(b)(1):  Conductors and parts of electric equipment that have been deenergized but have not been locked out or tagged in accordance with paragraph (b) of this section shall be treated as energized parts, and paragraph (c) of this section applies to work on or near them.  On or about July 23, 2020 an employee was working within the Amerimulch Colortrom Coloring Machines control panel exposed to contact with parts of fixed electric equipment or circuits without all circuits and equipment to be worked on being disconnected, deenergized and verification of condition from all electric energy sources in that, the Stateline generator control circuit devices, selector switches, was used as the sole means for disconnecting circuits or equipment without a lock and a tag being placed on the electrical voltage energy 480 volt Eaton electrical disconnecting means power source to deenergize circuits and equipment on which work is to be performed and no written safe procedures for deenergizing circuits and equipment had been established before circuits or equipment were attempted to be deenergized.
