Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burn, fire and explosion hazards.  a)   On or about August 26, 2020, and at times prior, the employer, Sphynx Investments, LLC, d/b/a Bucksnort Saloon, did not ensure the Imperial IR-6 Range Oven was equipped with a functioning thermostat safety valve to prevent propane gas release during pilot light shutoff.  A properly functioning thermostat safety valve does not allow propane gas to be released at any oven control knob setting unless the knob is on "Pilot" and depressed for pilot lighting or the pilot light is lit.    On August 26, 2020, a kitchen employee of Sphynx Investments, LLC d/b/a Bucksnort Saloon, was severely burned due to a propane gas explosion that was a direct result of a malfunctioning thermostat safety valve on the Imperial IR-6 Range Oven.  Abatement Note:  Among other methods, two feasible and acceptable ways to correct and/or prevent this hazard includes, but is not limited to the following:   (1)  Follow the National Fire Protection Association standard, NFPA 86 - Standard for Ovens and Furnaces, 2015 Edition, Chapter 8.8 Safety Shutoff Valves (Fuel Gas or oil) by supplying a functional thermostat safety valve for the fuel gas supply.   (2) Follow the Imperial IR-6 Range owner's manual instructions where it is stated:  "Your Imperial range should be checked for safe and efficient operation at least yearly by a qualified service company" and "Service of the equipment should be performed by qualified personnel who are knowledgeable with Imperial Ranges".
