29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  Jobsite:  On or about September 11, 2020, four employees were replacing an asphalt shingled roof on a residential home and none of the employees were protected from falling from the roof.  The fall hazard to the employees ranged from 8 to 16 feet.  The pitch of the roof was 3 in 12.

29 CFR 1926.503(c): When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer is to retrain each such employee such as inadequacies in an affected employee�s knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding of skill:  (a)  Jobsite:  On or about September 11, 2020, employees need to be retrained in how and when to use fall protection while working from a roof.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)  Jobsite:  On or about September 11, 2020, employees were using an aluminum extension ladder that only extended about 12 inches above the edge of the roof.  There was no type of grab rail for the employees to use when they used the ladder.  This ladder was the only way onto/from the roof.  The fall hazard to the employees was up to 16 feet.

29 CFR 1926.1060(b): The employer did not provide retraining as necessary for each employee using ladders and stairways so that the employee maintained the understanding and knowledge acquired through prior training:  (a)  Jobsite:  On or about September 11, 2020, the employer need to retrain his employees in how to properly set up and use ladders.  The owner and the employees were using an extension ladder to access a residential roof that only extended one foot above the roof.
