29 CFR 1926.651(a): All surface encumbrances that were located so as to create a hazard to employees were not removed or supported, as necessary, to safeguard employees: (a) A&E Services, LLC at 7313 Colfax Ave, Denver, CO: On and around September 16, 2020, the employer did not ensure that an employee working inside an excavation that measured approximately 6 feet in depth was protected, in that a Bobcat E35 R-Series Compact Excavator, weighing approximately 7909 pounds, was parked within 2 feet of the edge of the excavation and the excavation was located next to a busy street with vehicular traffic, while being outside the protection of a shield system. This condition exposed the employee to a crushing hazard by excavation wall cave-in. Abatement Note: 29 CFR 1926 Subpart P Appendix B(c)(3)(iii) states that when surcharge loads from stored material or equipment, operating equipment, or traffic are present, a competent person shall determine the degree to which the actual slope must be reduced below the maximum allowable slope, and shall assure that such reduction is achieved. Surcharge loads from adjacent structures shall be evaluated in accordance with 29 CFR 1926.651(i).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) A&E Services, LLC at 7313 Colfax Ave, Denver, CO: On and around September 16, 2020, the employer did not ensure that an employee working in an excavation with near vertical walls was protected from cave-in, in that the employer was in the excavation without a protective system. The excavation was 6 feet in depth, 6 feet wide, and 7 feet long. This condition exposed the employee to a crushing hazard by excavation wall cave-in.
