29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about October 1, 2020, and at times prior thereto, the employees performing masonry activities were not provided a ladder to access and egress the upper levels of a pole scaffold and exposed to fall hazards.

29 CFR 1926.451(f)(15): Ladders were used on scaffolds to increase the working level height of the employees: On or about October 2, 2020 and at times prior thereto, six (6) foot ladders were used to increase the working level height of the employees performing masonry activities on a scaffold exposing the employees to a fall hazard up to 18 feet to the ground below.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews: On or about October 2, 2020, and at times prior thereto, the employer did not provide guardrail systems on all sides of the scaffold to ensure employees were protected from fall hazards.
