Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) 6804 S. Ensenada Street, Aurora CO 80016: On or about October 5, 2020, and at times prior, the employer, DJV Concrete and Caisson Drilling, Inc. failed to keep the workplace free of hazards during caisson drilling operations. Employees working around hoisted loads were exposed to struck-by hazards from a falling pipe due to the Reedrill Texoma 600 Auger Drill being operated in an unsafe manner, not in accordance with the operator's manual. The feed ram arm was used to swing a hoisted caisson casing. The casing disconnected from the hoist hook and fell approximately 10 feet before bouncing off the ground, striking an employee in the head.

29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) 6804 S. Ensenada Street, Aurora CO 80016: On or about October 5, 2020, and at times prior, the employer, DJV Concrete and Caisson Drilling, Inc. did not instruct employees in the recognition of unsafe conditions in that employees were not provided with a copy of the operator's manual. Employees were not provided with training to recognize and correct safety hazards presented by operating the auger drill in a manner restricted by the manufacturer. Employees were exposed to falling objects due to the Reedrill Texoma 600 Auger Drill not being used in accordance with the operator's manual. The feed arm was used to swing a hoisted caisson casing, contrary to guidance in the operator's manual. Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a.) 6804 S. Ensenada Street, Aurora CO 80016: On or about October 5, 2020, and at times prior, the employer, DVJ Concrete and Caisson Drilling, did not enforce use of protective helmets when there was a possible danger of head injury from impact or falling objects. On October 5, 2020, two employees were working in the fall zone of a 30 foot long steel pipe casing that was lifted in the air approximately 10 feet high. The employees were not wearing hard hats. The pipe came loose from the hoist hook and fell to the ground, striking both employees in the head after it bounced on the ground. Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).
