29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Juan Ruelas, at a jobsite located at 7125 Sea Breeze West, Building 1, Sunbury, Ohio 43074: On and/or preceding October 14, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to a fall protection program for employees conducting framing work.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Juan Ruelas, at a jobsite located at 7125 Sea Breeze West, Building 1, Sunbury, Ohio 43074: On and/or preceding October 14, 2020, the employer did not ensure employees were protected from falls while engaged in residential framing activities. Employees were working while standing on the top plate of the walls while exposed to fall hazards of up to 20 feet.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Juan Ruelas, at a jobsite located at 7125 Sea Breeze West, Building 1, Sunbury, Ohio 43074: On and/or preceding October 14, 2020, the employer did not ensure employees were trained on the recognition of fall hazards or the procedures required to be followed to minimize the fall hazards. Employees, without fall protection training, were conducting framing activities while working on the third story of an apartment building, thereby exposed to fall hazards of up to 20 feet.
