29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees, were exposed to fall, struck-by and crushed-by hazards from equipment integrity failure: a) On October 12, 2020, at the jobsite located at 1151 Tower Blvd. Lake Wales, Florida, an employee was tree trimming while on a mobile elevating work platform (2018 CMC 83 HD Arbor Pro Lift), the hydraulic upper telescopic boom group had a failure and plummeted at least 50 feet to the ground. The mobile elevating work platform had not been frequently and annually inspected. Pursuant to 29 CFR 1903.19, abatement certification and documentation is required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.67(c)(2)(v): (v) A personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I, shall be worn and attached to the boom or basket when working from an aerial lift. a) On October 12, 2020, at the jobsite located at 1151 Tower Blvd. Lake Wales, Florida, an employee was tree trimming while on a mobile elevating work platform (2018 CMC 83 HD Arbor Pro Lift) without any means of fall arrest system as a harness and lanyard attached to the basket, exposed to at least a 50 foot fall hazard.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. a) On October 12, 2020, at the jobsite located at 1151 Tower Blvd. Lake Wales, Florida, an employee suffered a work -related injury that resulted in injuries to the head, neck and back. The employer was aware of the hospitalization on October 12, 2020 following the incident. The employer id not notified OSHA.
