29 CFR  1910.134(c)(2)(i):Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  Shapiro Brothers of Illinois Inc. dba Milano Metals & Recycling located at 510 S. 6th Street, Mount Vernon, IL 62864:  On 11/1/20, the employer had not provided respirator users with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible.  The employer allowed the employee to voluntarily wear an N95 filtering face piece to protect from inhaling nuisance dust and metal dust.  The employee chose not to  wear it anymore because it was hard for him to breath with it on, and had never been given or heard of Appendix D nor the information therein.

Employees receive ferrous and non-ferrous metals to include, but are not limited to, lead batteries and lead fishing weights.
