29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed.  a. Located at 6890 Lobelia Drive, New Albany, Ohio: On or about October 21, 2020, an employee was utilizing a 6 foot A-frame Werner portable step ladder to access the second-story trusses to perform framing work. The ladder was leaned against the first story framing in the closed position while in use. As a result, employee was exposed to falls and resulting injuries from the ladder due to improper and unsafe use of the ladder.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step.  a. Located at 6890 Lobelia Drive, New Albany, Ohio: On or about October 21, 2020, an employee was utilizing a portable Werner 6-foot A-frame stepladder to access the trusses of the second-story of the residential structure being built. The top of the stepladder as well as the top step of the stepladder were used to access the above trusses. As a result, the employee was exposed to falls due to utilizing the stepladder in a way in which it was not designed.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. Located at 6890 Lobelia Drive, New Albany, Ohio: On or about October 21, 2020, an employee was taking measurements and performing framing work from the top plate of a first story wall without fall protection, thereby exposed to an approximately nine foot fall hazard.  b. Located at 6890 Lobelia Drive, New Albany, Ohio: On or about October 21, 2020, an employee was performing framing work from the bottom web of the first story trusses without fall protection, thereby exposed to an approximately ten foot fall hazard.  Tito And Edward Construction was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1273419, citation number 1, item number 1 and was affirmed as a final order on November 29, 2017, with respect to a workplace located at Woodsbury Landing, Lot 50, Courtyards at Bradford Court, Powell, OH 43065.
