29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Unit C (Ground Area ): On or about October 23, 2020, the employer did not ensure that hard hats were used by employees on the ground level while employees on the roof above were performing roofing operations and throwing roofing materials to the ground; exposing ground employees to struck-by hazards.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Unit C (Roof Area ): On or about October 23, 2020, and times prior; the employer allowed his employees to perform roofing activities on a low-slope roof without fall protection exposing his employees to fall hazards up to approximately eighteen feet (18') to the ground or concrete below.
