29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d):  29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.   On or about November 18, 2020, and at times prior thereto, employees were operating a Yale Forklift (Serial#  A810N04878W) to move materials and elevate personnel via a job made platform without training on its safe operation.

29 CFR  1926.451(a)(6):Scaffolds were not designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.  On or about November 18, 2020, and at times prior thereto, employees were exposed to a fall hazard while using a job made platform, elevated by a Yale forklift, that was not designed by a qualified person.

29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.  On or about November 18, 2020, and at times prior thereto, employees were exposed to a fall hazard while riding in a job made platform, elevated by a Yale forklift, that was not designed for such use by the manufacturer.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated  On or about November 18, 2020, and at times prior thereto, employees were exposed to a fall hazard while operating a JLG 460SJ Telescopic Boom Lift to access a roof  without fall protection.
