29 CFR  1910.146(d)(1):Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not implement the measures necessary to prevent unauthorized entry:  (a) Oahe Grain Corporation at 300 Ash Avenue, Onida, SD 57564:  On or about and at times prior to November 18, 2020, the employer did not ensure that unauthorized entry into permit-required confined spaces was prevented, in that employees entered the corn palace pit to correct issues and did not have the required permitting to enter.  This condition exposed employees to atmospheric and mechanical hazards.

29 CFR  1910.146(c)(2):The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:  (a)Oahe Grain Corporation at 300 Ash Avenue, Onida, SD 57564:  On or about and at times prior to November 18, 2020 the employer did not ensure that all permit spaces were identified by posting danger signs or by any other equally effective means in that the "corn palace distributor" was not marked as a permit confined space.  (b)Oahe Grain Corporation at 300 Ash Avenue, Onida, SD 57564:  On or about and at times prior to November 18, 2020 the employer did not ensure that all permit spaces were identified by posting danger signs or by any other equally effective means,  in that the "number 4 dump pit tunnel" was not marked as a permit confined space.  (c)Oahe Grain Corporation at 300 Ash Avenue, Onida, SD 57564:  On or about and at times prior to November 18, 2020 the employer did not ensure that all permit spaces were identified by posting danger signs or by any other equally effective means,  in that the "number 2 dump Pit boot pit" was not marked as a permit confined space.  (d)Oahe Grain Corporation at 300 Ash Avenue, Onida, SD 57564:  On or about and at times prior to November 18, 2020 the employer did not ensure that all permit spaces were identified by posting danger signs or by any other equally effective means,  in that the "number 3 dump pit boot pit" was not marked as a permit confined space..  Abatement Note: A sign reading DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.
