29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) Premier Contracting, LLC at Hawthorn Avenue, Onida, SD 57564:  On or about and at times prior to November 18, 2020, the employer did not ensure that employees were adequately trained to recognize and avoid unsafe conditions while working on the site.  Employees were exposed to various hazards while working on the site to include cave-in, struck-by, atmospheric, and ladder hazards.

This condition exposed employees to struck-by hazards associated with excavated material rolling or falling into the excavation.

(a) Premier Contracting, LLC at Hawthorn Avenue, Onida, SD 57564:  On or about and at times prior to November 18, 2020, the employer did not ensure that employees conducting work in an excavation were protected from cave-in, in that the excavation was approximately 9 feet deep and lacked an adequate protective system such as sloping, benching, or shield system. This condition exposed employees to struck-by and crushing hazards associated with a trench wall collapse.

29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  (a) Premier Contracting, LLC at Hawthorn Avenue, Onida, SD 57564:  On or about and at times prior to November 18, 2020, the employer did not ensure that daily inspections of the excavation were made by a competent person in that employees were working within an eight foot deep excavation with vertical walls, no cave-in protection, and spoil pile less than two feet from the edge of the excavation. This condition exposed employees to struck-by hazards due to cave-in and crushing hazards.

29 CFR  1926.1053(b)(4): Ladder was used for purposes other than the purpose for which it was designed:  (a) Premier Contracting, LLC at Hawthorn Avenue, Onida, SD 57564:  On or about and at times prior to November 18, 2020, the employer did not ensure that the section of extension ladder was being used in accordance with manufacturer's recommendations in that the crew on site was utilizing a separated section of the Werner extension ladder to gain access into and out of an approximately nine foot deep excavation.
