29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a) Northern Plains LLC at Hawthorn Avenue, Onida, SD 57564:  On or about and at times prior to November 18, 2020, the controlling employer did not ensure that frequent and regular inspections of the job site had been accomplished  by a competent person.  Subcontracted employees were performing excavation activities on site with no protective system in place, spoils piles less than two feet from the edge of the excavation, atmospheric, and ladder hazards.  This condition exposed subcontracted employees to struck-by, crushing, health, and fall hazards.
