29 CFR  1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent persons designated by the employers:  On or about November 19, 2020, employees were framing the apartments under construction without fall protection up to approximately 30 feet high without the employer ensuring that frequent and regular inspections of the job site were conducted by a competent person; exposing employees to the hazards associated with their work.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  On or about November 19, 2020, an employee was using a pneumatic nail gun to frame the residential apartment complex under construction without eye protection, exposing employees to the hazard of being struck by flying objects.
