29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: On or about September 2, 2020, Employees of Neighbors Exterior Solutions LLC were performing roofing work on a commercial building located at 1117 Gravois Road, Fenton, Missouri. Employees working on the roof were exposed to electrical hazards due to overhead power lines. The employer failed to ensure the power lines near the work area were de-energized, insulated, or guarded while employees worked nearby. At approximately 3:00pm two employees were shocked while removing an aluminum ladder when the power lines arc flashed injuring two employees.

29 CFR 1926.1053(b)(12): Ladders used where the employee or the ladder could contact exposed energized electrical equipment did not have nonconductive side rails: On or about September 2, 2020, Employees of Neighbors Exterior Solutions LLC were performing roofing work on a commercial building located at 1117 Gravois Road, Fenton, Missouri. Employees were using an aluminum extension ladder >10 feet away from energized power lines to access the roof of the building, exposing employees to electric shock and fall hazards.

Employees are not adequately trained in the requirements and hazards associated with using an aluminum extension ladder near energized power lines. Employees working at the jobsite were exposed to electric shock and fall hazards.

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA: On or about September 2, 2020, the employer did not report to OSHA an employee injury resulting in an in-patient hospitalization. Two employees were injured when an energized power line arc flashed onto an aluminum ladder resulting in hospitalization of at least one employee. The employer failed to notify the Occupational Safety and Health Administration (OSHA).
