29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards:: On or about December 5, 2020, employees were using a Triton vacuum system to remove sediments from the inside of a tank. Prior to placing onto operation, the employer did not record verification that the vacuum system was adequately grounded in accordance with the National Electric Code, Article 250.

29 CFR 1910.242(a):General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees: On or about December 5, 2020, employees were using non-intrinsically safe tools such as but not limited to a Dewalt cordless drill, to secure and remove bolts and flang from a metal box in close proximity to flammable materials, exposing the employees to fire hazards.
