29 CFR  1910.132(a): Protective equipment was not maintained in a sanitary and reliable condition:   OPERATORIES:  On or about December 7, 2020, the employer did not ensure that isolation gowns used to protect against the SARS-CoV-2 virus were maintained in a sanitary condition. Employees engaged in direct patient care, including, but not limited to aerosol generating procedures, were required to re-use disposable isolation gowns.

29 CFR  1910.134(d)(1)(i): Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability:  OPERATORIES:  On or about December 7, 2020, employees engaged in direct patient care including, but not limited to aerosol-generating procedures such as ultrasonic scaling and assisting while high-speed dental hand-pieces were being used, were given the option of wearing N-95 respirators or Level 3 Surgical masks.  At a minimum, a NIOSH-certified N-95 filtering facepiece respirator is necessary to protect employees from aerosolized SARS-CoV-2 virus.

29 CFR  1910.1030(c)(1)(iv):The Exposure Control Plan shall be reviewed and updated at least annually and whenever necessary to reflect new or modified tasks and procedures which affect occupational exposure and to reflect new or revised employee positions with occupational exposure. The review and update of such plans shall also:  COMPANY-WIDE:  On or about December 7, 2020, the employer had not reviewed and updated the Blood-Borne Pathogens Exposure Control Plan since it was implemented in 2018.
