29 CFR  1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  A.)  David L. Lesonik, Jr. dba Dave Lesonik Contracting, 5148-5154 Peach Street, Erie, Pennsylvania  16509, east side of the plaza, on or about December 9, 2020 and times prior thereto:  Employees were in a JLG 400S aerial lift performing work duties that included, but was not limited to, screwing in starter strip to a parapet wall.  The employees were not utilizing a personal fall arrest harness with a lanyard attached to the boom / basket of the aerial lift when the aerial lift was in the elevated position.  Employees were exposed to a fall hazard of at least 14-feet.  ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.
