29 CFR  1910.134(d)(1)(ii): The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification:  a)Cedar Grove Respiratory and Nursing Care Center located at 1420 Black Horse Pike, Williamstown NJ: On or about 12/10/2020, the employer did not provide NIOSH-certified respirators to CNAs, LPNs, and RNs who were required to provide patient care and housekeeping staff required to clean rooms of suspected and confirmed positive COVID-19 patients.  The employer provided and required employees to wear respirators labeled "KN95".

29 CFR  1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:    a) United Methodist Community Nursing Home located at 1420 S Black Horse Pike Willimastown NJ: On or about 12/10/20, the employer did not provide a fit test to all employees required to wear respirators.  The employer required employees to wear N95 and KN95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents. The violation occurred on or about 12/10/20 and after.
