29 CFR 1926.100(a):  Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:     On or about December 16, 2020, an employee was not wearing a protective helmet where there was a possible danger of head injury from falling objects. Employees were throwing roofing materials off a residential roof onto the ground level, exposing the employee to struck-by hazards from falling objects.    No abatement certification or documentation is required for this item.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    On or about December 16, 2020, employees were exposed to fall hazards between 13 feet and 25 feet high while engaged in residential roofing activities.  Fall protection was not being utilized while performing roofing operations.      Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head.  On or about December 16, 2020, an employee was exposed to fall hazards between 20 feet and 25 feet high while performing roofing operations on a residential property.  An employee was observed not using fall protection correctly when his lifeline lanyard was connected to the front of his harness while performing roofing operations.    No abatement certification or documentation is required for this item.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:   On or about December 16, 2020, employees performing roofing work at a residential property were exposed to fall hazards between 13 feet and 25 feet with no fall protection when the employer failed to ensure they were adequately trained to recognize and minimize the hazards associated with fall.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
