OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to stuck-by and crush-by hazards:   a) Production Department (Warehouse Back Rack System ); On or about December 15, 2020, and at times prior thereto the employer failed to anchor and bolt down storage racks to prevent employees from exposure to struck-by and/or crush hazards when working near storage racks. Additionally, the employer failed to ensure that a placard indicating the storage racks maximum loading capacity was conspicuously displayed on the racks to ensure the rack wouldn't become overloaded.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated, the person certifying that the evaluation has been performed, the date(s) of the hazard assessment, and, which identifies the document as a certification of hazard assessment:  a) Production Department/Facility (Dothan, AL): On or about December 15, 2021, and at times prior,  the employer failed to perform a workplace hazard assessment through written certification for the facility to determine the hazards and the necessary personal protective equipment for tasks being performed.
