On or about December 6, 2020, and times prior to, employee was operating band saw, Hobart band saw  model number 6801-serial number 27-1173-593, when his middle and ring fingertips were amputated.   2. On or about December 16, 2020, and times prior to, employee was operating the bandsaw, Hobart band saw model number 6801-serial number 27-1173-593, with the adjustable guard set higher than the one-quarter of an inch stated in the posted sign above the band saw.   3. On or about December 22, 2020, and times prior to,  employee was operating the bandsaw, Hobart band saw  model number 6801-serial number 27-1173-593, with the adjustable guard set higher than the one-quarter of an inch stated in the posted sign above the band saw.

29 CFR  1910.212(a)(3)(iii):Special handtools for placing and removing material were not used as permitted for easy handling of material without the operator placing a hand in the danger zone. Such tools should not be used in lieu of other guarding required by this section, but can only be used to supplement protection provided.  On or about December 6, 2020 and at times prior thereto, the employer did not ensure employees were protected against amputation hazards due to not utilizing a special hand tool that would keep employee's hands further from the danger zone.
