29 CFR  1926.501(b)(1): Employees on walking/working surfaces with an unprotected side and/or edge which is 6 feet or more above a lower level were not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:   a) On December 29, 2020, and at times prior, at worksite on Kiryas Joel,  the employer did not use fall protection for employees leaning out of window openings exposed to a 40 - 50 foot fall while attaching wall sheeting to the building exterior.  b) On December 29, 2020, and at times prior, at worksite on Kiryas Joel,  the employer did not properly protect the building stairway, and fourth floor door openings by installing mid-rails.  The JCA Construction Service, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), under the company name of JCA Construction, LLC, which was contained in OSHA inspection number 1394809, citation number 1, item number 2A and was affirmed as a final order on May 31, 2019, with respect to a workplace located at 30-40 Brwer Lane, Hillsborough, NJ 08844.  The JCA Construction Service, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), under the company name of JCA Construction, LLC, which was contained in OSHA inspection number 1314542, citation number 1, item number 1 and was affirmed as a final order on Oct 4, 2018, with respect to a workplace located at 535 Broadway, Paterson, NJ 07514.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) On December 29, 2020, and at times prior, at worksite on Kiryas Joel,  the employer did not provide fall protection training for employees observed leaning out of window openings attaching wall sheeting exposed to a fall hazard of 40 feet.  The JCA Construction Service, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(b)(1), under the name JCA Construction, LLC, which was contained in OSHA inspection number 1394809, citation number 1, item number 2B and was affirmed as a final order on May 31, 2019, with respect to a workplace located at 3-040 Brwer Lane, Hillsborough, NJ 08844.
