29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement:  a) Worksite, 539 East Shore Rd., Kings Point, NY- Employees were exposed to an impalement hazard while working directly above protruding reinforcing steel (rebar) at a residence being constructed. The protruding rebar was not capped to eliminate the hazard of impalement; on or about 12/31/20.   Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1926.761(b): The employer did not train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program.  a) Worksite, 539 East Shore Rd., Kings Point, NY- Employees installing metal decking on the second floor of an iron framework were exposed to falling approximately 30ft. Employees were not trained in the recognition of fall hazards; on or about 12/31/20.  Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.760(a)(1):  Employee(s) engaged in steel erection activity who were on a walking/working surface with an unprotected side or edge more than 15 feet (4.6m) above a lower level were not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems:   a) Worksite, 539 East Shore Rd., Kings Point, NY- Employees  engaged in steel erection activities while installing metal decking more than 30 feet in height were not protected from falls; on or about 12/31/20.  Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.  72 Steel and Aluminum Work, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.760(a)(1) , which was contained in OSHA inspection number 1371667, citation number 1, item number 7 and was affirmed as a final order on 10/15/2019, with respect to a workplace located at 4611 7th Ave., Brooklyn, NY.
