29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  a) Epiphany Developments, LLC., at 2311 King Street, Denver, CO 80219: On or before January 4, 2021, the controlling employer did not ensure that subcontractor employees wore protective helmets during framing activities. Subcontractor employees were working on the second level of a new, residential townhome with overhead hazards from constructing and raising outer walls .  This condition exposed employees to head injuries from falling objects.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Epiphany Developments, LLC., 2311 King Street, Denver, CO 80219: On or before January 4, 2021, the controlling employer did not ensure that 5 subcontractor employees were protected from injury, in that employees actively engaged in framing activities on the second level of a new, residential townhome were not utilizing a fall protection system while working near the leading edge.  This condition exposed subcontractor employees to a fall hazard of 20 feet.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.   a) Epiphany Developments, LLC., 2311 King Street, Denver, CO 80219: On or before January 4, 2021,  the controlling employer did not ensure that the ladders subcontractor employees were using to access the second level, upper landing surfaces; extended 3 feet above the upper landing areas nor was it secured at its top. 5 subcontractor employees engaged in framing activities on a new, residential townhome, did not have their extension ladder adjusted correctly so that the side rails extended at least 3 feet above the work surface or was secured at its top. This condition exposed the subcontractor employees to a fall hazard of 10 feet.
