29 CFR 1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a) Jose Oliverio Larios Morales, at a jobsite located at 7125 Sea Breeze West, Building 5, Sunbury, Ohio 43074 : On and/or preceding January 2, 2021, the employer failed to initiate and maintain a safety and health program such as but not limited to a fall protection program for employees conducting roofing work.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Jose Oliverio Larios Morales, at a jobsite located at 7125 Sea Breeze West, Building 5, Sunbury, Ohio 43074 : On and/or preceding January 2, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. An employee was installing ice guard underlayment to the roof of a new construction three story roof without fall protection. The employee fell 30 feet from the roof, resulting in the death of the employee.

29 CFR 1926.502(e)(2):Positioning devices shall be secured to an anchorage capable of supporting at least twice the potential impact load of an employee's fall or 3,000 pounds (13.3 kN), whichever is greater. a) Jose Oliverio Larios Morales, at a jobsite located at 7125 Sea Breeze West, Building 5, Sunbury, Ohio 43074 : On and/or preceding January 2, 2021, the employer failed to ensure anchorages were capable of supporting at least twice the potential impact load of an employee's fall or 3,000 pounds. Employees used ropes, which were nailed through the ropes to the roof, for positioning while working on the roof of a three story apartment building. This lack of an adequate anchorage thereby exposed the employees to fall hazards of 30 feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a) Jose Oliverio Larios Morales, at a jobsite located at 7125 Sea Breeze West, Building 5, Sunbury, Ohio 43074 : On and/or preceding January 2, 2021, the employer did not ensure employees were trained on the recognition of fall hazards or the correct procedures required to be followed to minimize the fall hazards. Employees, without fall protection training, were conducting roofing activities while working on a three story new construction apartment building, thereby exposed to fall hazards of up to 30 feet.
