29 CFR  1910.135(a)(1):The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  a. At 147 Linden Road, St. Augustine FL: On or about January 6, 2021, the employer exposed the employees to struck-by hazards in that employees working from the ground not wearing a head protection, such as a hard hat, while employees cut and felled trees and tree branches.

At 147 Linden Road, St. Augustine FL: On or about January 6, 2021, the employer exposed the employees to struck-by hazards in that an employee cutting tree branches on the ground was not removed from the drop zone while a tree was cut and felled to the ground.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye:  a. At 147 Linden Road, St. Augustine FL: On or about January 6, 2021, the employer exposed the employees to struck-by hazards in that an employee cutting tree branches was not removed from a tree felling drop zone and was injured. The work related incident resulted in in-patient hospitalization and the employer did not report it to OSHA within 24-hours of occurring.
