29 CFR 1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Don Rice Contracting LLC at 12853 Tamarac St, Thornton, CO: On and around January 14, 2021, the exposing, creating, and correcting employer did not ensure that daily inspections were conducted by a competent person of two adjacent trenches that were approximately 20 feet long and 3 feet wide with depths varying from 6 to 7 feet to protect employees from trench wall cave-in. Employees were connecting sewer lines in the two trenches with type B soil that were benched from the bottom with approximate 5 foot vertical cave walls to 2 foot horizontal bench steps to 1 to 2 foot vertical cave walls to the upper level. This condition exposed employees to crushing hazards by trench wall cave-in.

29 CFR 1926.652(b)(2):Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart: (a) Don Rice Contracting LLC at 12853 Tamarac St, Thornton, CO: On and around January 14, 2021, the exposing, creating, and correcting employer did not ensure that each employee working inside two adjacent trenches that were approximately 20 feet long and 3 feet wide with depths varying from 6 to 7 feet were protected from cave-in with an allowable benching system. Employees were connecting sewer lines in the two trenches with type B soil that were benched from the bottom with approximate 5 foot vertical cave walls to 2 foot horizontal bench steps to 1 to 2 foot vertical cave walls to the upper level. This condition exposed employees to crushing hazards by trench wall cave-in.
