29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: (a) Cesare, Inc. at 1013 N 25th Ave, Greeley, CO 80631: On and before January 14, 2021, the exposing employer did not ensure that daily inspections of an excavation that measured approximately 140 feet in length, 16 feet in width, and had one nearly-vertical side wall which was 7.5 feet in height from its base, was protected from cave-in. Workers were operating a BMR 8500 compactor inside the excavation and a front-end loader Komatsu WA250 on top of the excavation. An employee and a subcontractor were working next to the unprotected cut-off wall, which was Type B soil, when it caved-in. The employee was not struck by the cave-in and did not sustain injuries; however, the subcontractor was caught in the cave-in and subsequently died. Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: (a) Cesare, Inc. at 1013 N 25th Ave, Greeley, CO 80631: On and before January 14, 2021, the exposing employer did not ensure that each employee working in an excavation that measured approximately 140 feet in length, 16 feet in width, and had one nearly-vertical side wall which was 7.5 feet in height from its base, was protected from cave-in.
