29 CFR  1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) Jan-Care of Tri-State, Inc. located at 1301 7th Avenue, Suite D Huntington, WV 25701 :  On or about January 23, 2020 and times prior, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). The employer required employees to wear respirators throughout their shifts while exposed to suspected or confirmed positive COVID-19 patients.

29 CFR  1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested whenever a different respirator facepiece (size, style, model or make) was used:  (a) Jan-Care of Tri-State, Inc. located at 1301 7th Avenue, Suite D Huntington, WV 25701   On or about January 23, 2020 and times prior, the employer did not provide a fit test on the same make, model and size of respirator required to be used by the employees. The employer required employee use of N95 face filtering respirators to protect against SARS-Co-V-2 virus while providing healthcare for suspected and confirmed COVID-19 positive patients.
