On or about January 22, 2020, employees were on a walking-working surface that had unprotected sides and was approximately 12 feet above a lower level without the use of a means for fall protection , exposing employees to the hazard of falling from an elevated surface from heights greater than 6 feet.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about January 22, 2020, employees using a portable ladder to  access a upper landing surface did not ensure the ladder side rails extended at least 3 feet above that surface before access was gained , exposing employees to the hazards of falling from ladder.
