29 CFR 1910.146(d)(1): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not implement the measures necessary to prevent unauthorized entry: (a)Central Farmers Cooperative at 210 East 17th Avenue, Tyndall, SD 57066: On or about and at times prior to January 28, 2021, the employer did not ensure that unauthorized entry into permit-required confined space was prevented in that, employees were entering the main elevator boot pit for housekeeping and did not have the required permitting to enter. This condition exposed employees to atmospheric and mechanical hazards.

29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces: (a)Central Farmers Cooperative at 210 East 17th Avenue, Tyndall, SD 57066: On or about and at times prior to January 28, 2021, the employer did not ensure that all permit spaces were identified by posting danger signs or by any other equally effective means in that the "elevator boot bit" was not marked as a permit-required confined space. Abatement Note: A sign reading DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.
