29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). On or about January 29, 2021, at the jobsite, the employer did not ensure that employees, installing a fireplace from the roof of a residential building, were in use of fall protection. This exposed the employees to a fall greater than six(6) feet to the ground below.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. On or about January 29, 2021, at the jobsite, the employer did not ensure that the ladder side rails extended at least three (3) feet above the upper landing surface. This exposed the employees to a fall hazard.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed. On or about January 29, 2021, at the jobsite, the employer did not ensure an A-frame ladder was being used according to the manufacturer use requirements. The ladder was leaned against the side of a chimney on the roof of a building and this exposed the employees to a fall hazard.
