29 CFR 1910.134(c)(1):  A written respiratory protection program with worksite specific procedures, as specified in subparagraphs (c)(1)(i) through (ix) of this section, was not established and implemented where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer:  (a)Central Plains Industries, LLC at 42989 US Hwy 212, Clark, SD 57225: On or about and at times prior to January 26, 2021, the employer did not ensure a written respiratory protection program with worksite specific procedures, as specified in subparagraphs (c)(1)(i) through (ix) of this section.  The program was not established and implemented whenever respirators were required by the employer, in that the employer provided a 3M half-face, negative pressure, air-purifying respirator to an employee while conducting sanding operations on equipment prior to powder coating.  This hazard exposed the employee to the lack of knowledge of proper respirator use.  Abatement Note:  The employer shall include in the program the following provisions of this section, as applicable:  (1)	Procedures for selecting respirators for use in the workplace;  (2)	Medical evaluations of employees required to use respirators;  (3)	Fit testing procedures for tight-fitting respirators;  (4)	Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations;  (5)	Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators;  (6)	Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators;  (7)	Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations;  (8)	Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and  (9)	Procedures for regularly evaluating the effectiveness of the program.

29 CFR 1910.147(c)(1):  The employer did not establish a program consisting of an energy control procedure and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative in accordance with 29 CFR 1910.147(c)(4):   (a)Central Plains Industries, LLC at 42989 US Hwy 212, Clark, SD 57225: On or about and at times prior to January 26, 2021, the employer did not ensure a program consisting of an energy control procedure and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative, including but not limited to the following:  (1)	Mitsubishi ML3015 LVP (2)	Komo VMC 120 Vertical Machining Center  Abatement Note:  As part of an energy-control program, employers must:  (1)	Establish energy-control procedures for removing the energy supply from machines and for putting appropriate lockout or tagout devices on the energy-isolating devices to prevent unexpected reenergization.  When appropriate, the procedure also must address stored or potentially reaccumulated energy.  (2)	Train employees on the energy-control program, including the safe application, use, and removal of energy controls; and  (3)	Inspect these procedures periodically (at least annually) to ensure that they are being followed and that they remain effective in preventing employee exposure to hazardous energy.  The energy-control procedures must outline the scope, purpose, authorization, rules, and techniques that employees will use to control hazardous energy sources, as well as the means that will be used to enforce compliance.  These procedures must provide employees at least the following information:  (1)	A statement on how to use the procedures;  (2)	Specific procedural steps to shut down, isolate, block, and secure machines;  (3)	Specific steps designating the safe placement, removal, and transfer of lockout/tagout devices and identifying who has responsibility for the lockout/tagout devices; and  (4)	Specific requirements for testing machines to determine and verify the effectiveness of lockout devices, tagout devices, and other energy-control measures.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Central Plains Industries, LLC at 42989 US Hwy 212, Clark, SD 57225: On or about and at times prior to January 26, 2021, the employer did not ensure forklift operators were trained in the operation of powered industrial trucks. Employees utilized nine different forklifts in the facility to move material without training and evaluation prior to operation. This condition exposed employees to the hazard of improper forklift operation.   Abatement Note:  The certification shall include:     (1)  The name of the operator;  (2)  The date of the training;  (3)  The date of the evaluation; and,  (4)  The identity of the person(s) performing the training and evaluation.     Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a)Central Plains Industries, LLC at 42989 US Hwy 212, Clark, SD 57225: On or about and at times prior to January 26, 2021, the employer did not ensure employees were protected  from hazards associated with a CNC laser. The employer did not ensure the Mitsubishi ML3015 LVP was adequately guarded to prevent employees from having any part of their body in the danger zone during operating cycles. The laser was missing the safety door which protected the employee from coming into contact with the laser. This condition exposed the employees to the hazard of contact with the laser.  (b)Central Plains Industries, LLC at 42989 US Hwy 212, Clark, SD 57225: On or about and at times prior to January 26, 2021, the employer did not ensure employees were protected hazards associated with a CNC vertical machining center. The employer did not ensure the door was equipped with interlocks on the Komo VMC 50/120 Vertical Machining Center to prevent employees from having any part of their body in the danger zone during operating cycles. This condition exposed the employees to the hazard of contact with the laser.  (c)Central Plains Industries, LLC at 42989 US Hwy 212, Clark, SD 57225: On or about and at times prior to January 26, 2021, the employer did not ensure employees were protected from laceration hazards associated with a vertical bandsaw. The employer did not ensure the unused portion of the vertical bandsaw was effectively guarded. This condition exposed the employees to a laceration hazard.

29 CFR  1910.1200(e)(1): Employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks:   (a)Central Plains Industries, LLC at 42989 US Hwy 212, Clark, SD 57225: On or about and at times prior to January 26, 2021, the employer did not ensure that  a written hazard communication program was developed and implemented, which at least described how the criteria specified for labels and other forms of warning, safety data sheets, and employee information and training was met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks.  This condition exposed employees to chemical hazards during the manufacturing process.        Abatement Note:  The written hazard communication program will also include:   (1) A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,  (2) The methods the employer will use to inform employees of the hazards of non-routine tasks.  (3) The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets required by this section.
