29 CFR 1910.212(a)(1): One or more methods of machine guarding were not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a)Wheeler Lumber, LLC at 12127 Whitewood Service Road, Whitewood, SD 57793: On or about and at times prior to January 28, 2021, the employer did not ensure employees were protected from caught-in-between hazards associated with the point of operation involving the Incisor machine. The Incisor machine is equipped with four rollers that put small incisions in the wood. The rollers were not effectively guarded to ensure the operator was protected at the point of operation. Employees were also exposed to a struck-by hazard as a result of crossing over at the rear of the machine where lumber was moving after the operation was performed. This condition exposed the employees to caught-in-between and struck-by hazards. (b)Wheeler Lumber, LLC at 12127 Whitewood Service Road, Whitewood, SD 57793: On or about and at times prior to January 28, 2021, the employer did not ensure employees were protected from laceration and struck-by hazards associated with Mayflower 1492 planer. The back of the planer was not effectively guarded to ensure employees were protected from the point of operation. This condition exposed the employees to a laceration hazard and struck-by hazards associated with the back of the planer and the cutting head.

29 CFR 1910.213(g)(2): Sliding cutoff saw was not provided with an effective device to return the saw automatically to the back of the table when released at any point of its travel: (a)Wheeler Lumber, LLC at 12127 Whitewood Service Road, Whitewood, SD 57793: On or about and at times prior to January 28, 2021, the employer did not ensure employees were protected from laceration hazards associated with the point of operation involving the Delta swing arm saw. The saw did not automatically return to the back of the table once a cut was performed. This condition exposed the employees to laceration hazards.

29 CFR 1910.219(d)(1): Pulley(s) with part(s) seven feet or less from the floor or work platform were not guarded in accordance with the requirements specified at 29 CFR 1910.219(m) & (o): (a)Wheeler Lumber, LLC at 12127 Whitewood Service Road, Whitewood, SD 57793: On or about and at times prior to January 28, 2021, the employer did not ensure the belt and pulley assembly with parts seven feet or less from the floor or work platform were guarded. The power transmission assembly associated with the Mayflower 1492 planer consisted of four belts located on the floor in close proximity to the planer and were not effectively guarded. This condition exposed employees to an in-running nip point hazard.
