29 CFR  1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.   Location: Jobsite  On about February 8, 2021 The employer did not maintain a safety program which provided for frequent and regular inspection of this jobsite by a competent person when an employee was seriously injured while working in a steel soffit that was not structurally designed to support the load imposed on it by employees conducting demolition operations.

29 CFR  1926.1203(a): Before it begins work at a worksite, each employer must ensure that a competent person identifies all confined spaces in which one or more of the employees it directs may work, and identifies each space that is a permit space, through consideration and evaluation of the elements of that space, including testing as necessary.  Location: Jobsite  On or about February 8, 2021 employees were working inside a soffit that had a limited and restricted means for entry or exit and was not designed to contiguous employee occupancy and was configured that an employees body could enter it.

29 CFR  1926.1207(b):(b) Training required by this section must be provided to each affected employee:  Worksite  On or about Feburary 8, 2021, employees were exposed to confined space hazards such as asphyxia, electric shock and caught between while working where the employer had not provided training in recognizing and avoiding confined space hazards.
