29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Dotson Builders; at a jobsite located at 3299 Heraldmorn Drive, Lot 363, Reynoldsburg, Ohio 43068: On and/or preceding February 9, 2021, the employer failed to initiate and maintain a safety and health program such as but not limited to a personal protective equipment program, a fall protection program, and a ladder safety program, thereby exposing employees to struck-by hazards and fall hazards of up to 11 feet 6 inches.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Dotson Builders; at a jobsite located at 3299 Heraldmorn Drive, Lot 363, Reynoldsburg, Ohio 43068  On and/or preceding February 9, 2021, the employer failed to ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Framers were using a pneumatic nail gun to install roof trusses. The employees were not utilizing eye protection, thereby exposing employees to struck-by hazards to the eyes.

29 CFR  1926.1053(b)(4):Ladders shall be used only for the purpose for which they were designed.  a) Dotson Builders; at a jobsite located at 3299 Heraldmorn Drive, Lot 363, Reynoldsburg, Ohio 43068  On and/or preceding February 9, 2021, the employer did not ensure employees used ladders for the purpose in which they were designed. Employees were using a step ladder in the closed position and while leaning against a wall to access the roof, thereby exposed to falls from the ladder.

Employees used the top and top step of a stepladder, thereby exposed to a 6 foot fall hazard.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a) Dotson Builders; at a jobsite located at 3299 Heraldmorn Drive, Lot 363, Reynoldsburg, Ohio 43068  On and/or preceding February 9, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were installing trusses while standing on the top plate of the walls, thereby exposed to fall hazards of up to 11 feet 6 inches.  b) Dotson Builders; at a jobsite located at 3299 Heraldmorn Drive, Lot 363, Reynoldsburg, Ohio 43068  On and/or preceding February 9, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were working near an unguarded basement opening, thereby exposed to fall hazards of up to 10 feet.  Dotson Builder was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1204131, citation number 2, item number1 and was affirmed as a final order on February 14, 2017, with respect to a workplace located at 7467 Lawton Street, Galena, OH 43021.
