29 CFR  1910.30(a)(1):  Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart.  Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017.  (a)  The employer did not train employees on the use of personal fall protection systems when those employees were exposed to fall hazards while pressure washing the yogurt storage tanker from the top of the tank while it was parked in the wash bay for cleaning.

(a)  On or about February 19, 2021, the employer did not adequately evaluate the workplace to determine if any spaces were permit required confined spaces, such as but not limited to the yogurt storage tanker and other tankers that were used to deliver animal feed products to customers.

29 CFR  1910.146(c)(2): If the workplace contains permit spaces, the employer shall inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces.  NOTE: A sign reading DANGER -- PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.   (a)  On or about February 19, 2021, the employer had not informed employees if any spaces, such as but not limited to the yogurt storage tanker that was parked in the wash bay for cleaning,  were permit required confined spaces, by posting signs or by other equally effective means.

29 CFR  1910.1200(e)(1)(ii):   Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  The methods the employer will use to inform employees of the hazards of non-routine tasks (for example, the cleaning of reactor vessels), and the hazards associated with chemicals contained in unlabeled pipes in their work areas.  (a)  On or about February 19, 2021, the employer did not develop, implement or maintain a written hazard communication program in the workplace which addressed the methods the employer would use to inform employees of the hazards  of nonroutine tasks, such as but not limited to filling or cleaning the mobile yogurt storage tanker, which contained fermenting yogurt and low oxygen levels (asphyxiation.)
