29 CFR  1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) At the facility,  1455 Pinewood Blvd Mays landing, NJ :  On or about 3/1/2021 and thereafter, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). The employer required employees such as Licensed Practical Nurses, Registered Nurses, Doctors, and Facilities workers  to wear N-95 respirators throughout their shifts while providing care to confirmed COVID-19 positive residents.  ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED FOR THIS ITEM.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace:  (a) At the facility, 1455 Pinewood Blvd Mays Landing, NJ:  On or about 3/1/2021 and thereafter, the employer provided and required the use of N-95 respirators at the facility. The employer did not provide employees such as, but not limited to, Licensed Practical Nurses, Registered Nurses, Doctors and Facilities Workers with a medical evaluation prior to the use of the respirators. The employer required employees such as but not limited to Licensed Practical Nurses, Registered Nurses, Doctors, and Facilities Workers to wear N-95 respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.  ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED FOR THIS ITEM.
