29 CFR 1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) At the facility, 1455 Pinewood Blvd Mays landing, NJ : On or about 3/1/2021 and thereafter, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). The employer required employees such as Licensed Practical Nurses, Registered Nurses, Doctors, and Facilities workers to wear N-95 respirators throughout their shifts while providing care to confirmed COVID-19 positive residents. The employer did not provide employees such as, but not limited to, Licensed Practical Nurses, Registered Nurses, Doctors and Facilities Workers with a medical evaluation prior to the use of the respirators.
