29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  The employer does not protect each employee from eye injury caused by flying debris while performing roofing activities (installing material with air driven tools) on residential homes and or structures by ensuring the use of eye protection while engaging in work activities. This most recently occurred on March 3, 2021, during the installation of roofing material at a job site located at 4571 Massillon Rd, N. Canton, Ohio 44720; the employer did not ensure employees working on the roof of a residential single family home were protected from possible danger of eye injury from impact, or from flying objects from the employees installing roofing material with air driven nail guns.  To abate this hazard in the future, the employer must ensure employees are provided with, and required to use, eye protection in accordance with this standard, and that no employees are permitted to work while exposed to these hazards until protection is provided.    Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  The employer does not protect each employee from fall hazards while performing roofing activities on residential homes and or structures with unprotected sides and edges at height of approximately 10.1 feet above the ground by the use of guard rail systems, safety net systems, and or personal fall arrest systems. This most recently occurred on March 3, 2021, during the installation of roofing material at a job site located at 4571 Massillon Rd, N. Canton, Ohio 44720; employees are exposed to the hazard of falling approximately 10.1 feet to the ground while working on a roof of a single family home installing roofing material without the use of fall protection and or a fall protection system.  To abate this hazard in the future, the employer must ensure employees are provided with, and required to use, fall protection in accordance with this standard, and that no employees are permitted to work from elevations until protection is provided.
