29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift.  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:   a) This violation occurred on or about March 3, 2021, at a workplace located at 3575 W. Story Rd., Irving,  TX; where employees were working/using Skyjack SJ45T lift to access/egress the top of the building and were not protected from falling from aerial lift.

29 CFR  1926.501(b)(1):  Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a) This violation occurred on or about March 3, 2021, at a workplace located at 3575 W. Story Rd., Irving,  TX; where employees were working from the top of of the building, installing metal studs and were not protected from falling to the ground below.
