29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace:    a) Westchester Care at Home dba Visiting Nurse Service in Westchester at Home, White Plains, NY  The employer did not provide medical evaluation for Home Health aides who were required to wear 3M 8000 N95 particulate  respirators when conducting in-home visits for  patients whose Covid-19 status in unknown , on or about 2/6/21 and thereafter.   NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator was fit tested prior to initial use of the respirator:    a) Westchester Care at Home dba Visiting Nurse Service in Westchester at Home, White Plains, NY  The employer did not ensure that annual fit testing was conducted for home health aids  who were required to wear  as 3M 8000 N95 particulate  respirators  when conducting home visits for  patients whose Covid-19 status in unknown , on or about 2/6/21 and thereafter.    NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
