29 CFR  1926.102(a)(1):Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  On the west side of the construction site, an employee engaged in cutting masonry material with a DeWalt brick masonry saw was not wearing eye protection was exposed to struck-by hazards from flying particles.

29 CFR  1926.304(d): When the tool was withdrawn from the work, the lower guard did not automatically and instantly return to the covering position.   On the west side of the construction site, an employee operating a DeWalt cut off saw with lower guard wedged in the up position preventing it to return to the blade covering position while cutting brick material was exposed to cut and abrasion hazards.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.   On the west side of the construction site, the employer did not ensure the employee using a DeWalt cut off saw to cut masonry material was protected from being exposed to silica with the use of engineering controls, work practices and respiratory protection.
