29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest system:  a) Jobsite: On March 8, 2021 and at times prior thereto a fall protection system was not in place for employees while working on the flat "mezzanine" area of the roof installing insulation and flashing material on the parapet walls.  Employees were exposed to a fall hazards between 15 feet to a lower level and 30 feet to the ground below.   Note) Certification of corrective action is required for this item.

29 CFR  1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:   a) Mezzanine area on roof:  On March 8, 2021 and at times prior thereto the controlling employer, Wellens General Contractors, did not protect their employees nor did they ensure their sub-contractor protected it's employees from a floor hole on the roof mezzanine.  A guardrail system was not in place around a floor hole that was being used for ladder access to the mezzanine and roof deck.  This exposed the employees to a 15 foot fall hazard to the floor below.    Note) Certification of corrective action is required for this item.

29 CFR 1926.1052(b)(1): Foot traffic was not prohibited on stairways with pan stairs where the treads and/or landings were not filled in with concrete or other material, and the stairs were not temporarily fitted with wood or other solid material at least to the top edge of each pan:  a) Jobsite: On March 8, 2021 and at times prior thereto, the controlling employer Wellens General Contractors did not protect their employees from trip hazards, or ensure that its sub-contractors protected their employees while using a permanent metal stairway.   Wooden material that was used in the stair pans left them mostly empty, and was not flush with the top edge of each pan, creating a trip hazard.    Note) Certification of corrective action is required for this item.
